Al McTavish Photography Terms and conditions
1. Booking & Payment
1.1 Booking your session
A 30% booking fee is required to secure your session date. Your booking is confirmed once the booking fee has been received and your session has been accepted by Al McTavish Photography.
The booking fee is applied towards the total session fee.
1.2 Remaining balance
The remaining balance is due no later than the day of your session.
Payment may be made by bank transfer or another payment method agreed upon in advance.
1.3 Current session pricing
The Signature: $650
30% booking fee: $195
The Full Story: $1,000
30% booking fee: $300
The applicable session fee and collection selected at the time of booking will be confirmed in your booking confirmation.
2. Rescheduling & Cancellations
2.1 Rescheduling by the client
I understand that family life is unpredictable, particularly with young children and newborns.
If you need to reschedule your session, I will do my best to accommodate you and transfer your booking to a new available date.
Where possible, please provide at least 48 hours' notice.
2.2 Cancellation by the client
If you choose to cancel your session, please let me know as soon as possible.
The booking fee is generally retained to cover the date reserved for your session and the preparation undertaken in securing your booking. Any refund or credit will be considered in accordance with these terms and any rights you may have under Australian Consumer Law.
2.3 Rescheduling by Al McTavish Photography
In the unlikely event that I need to reschedule your session due to illness, emergency, severe weather or another unforeseen circumstance, I will work with you to find a suitable alternative date.
If a suitable alternative date cannot be agreed upon, I will refund payments made for services that have not been provided, subject to any rights and obligations under Australian Consumer Law.
3. Maternity & Newborn Sessions
3.1 Maternity sessions
Maternity sessions are generally photographed between 30 and 36 weeks, although the ideal timing can vary depending on your pregnancy and individual circumstances.
We will work together to choose a date that feels right for you.
3.2 Newborn sessions
Newborn sessions are photographed in the comfort of your home and are ideally scheduled within the first few weeks after birth.
I understand that babies do not always arrive according to plan. If your baby arrives earlier or later than expected, we will adjust your session date where possible.
3.3 A relaxed approach
Newborn sessions allow additional time for feeding, settling, changing, cuddling and simply being together.
There is no expectation that your baby will sleep throughout the session. The pace of the session will be guided by your baby and what feels comfortable for your family.
4. Sessions & Collections
4.1 The Signature
The Signature includes 20 professionally edited digital photographs from your session, delivered in colour and black & white.
4.2 The Full Story
The Full Story includes 50–70 professionally edited digital photographs from your session, delivered in colour and black & white.
4.3 Gallery upgrade
If you initially select The Signature, you may choose to upgrade to The Full Story after viewing your gallery.
The upgrade fee is $350.
The Full Story upgrade includes a $50 print credit towards eligible print and framing orders through the Al McTavish Photography online store.
4.4 Image selection
For The Signature, you will select your 20 favourite photographs from your completed gallery.
Once your selection has been made, those images will be professionally edited and delivered to you.
5. Image Delivery & Editing
5.1 Editing
All final photographs are professionally edited in the signature Al McTavish Photography style.
This includes colour correction, tonal adjustments, cropping where appropriate and artistic editing.
5.2 Creative discretion
The selection and editing of final images is an important part of my creative process. I carefully curate the photographs delivered to you and do not provide unedited or RAW files.
5.3 Gallery access
Your private online gallery will remain available for three weeks from the date it is delivered.
Please ensure you download and safely back up your images during this period.
Al McTavish Photography is not responsible for permanently storing client galleries once the gallery access period has expired.
6. Copyright & Personal Usage
6.1 Copyright
All photographs remain the copyright and intellectual property of Al McTavish Photography.
Copyright is not transferred to the client upon purchase of the images.
6.2 Personal usage
Clients are granted a personal, non-exclusive licence to download, print, share and display their purchased photographs for personal, non-commercial purposes.
This includes sharing images on personal social media accounts.
6.3 Commercial use
Images may not be used for commercial advertising, business promotion, publication, resale, licensing or other commercial purposes without prior written permission from Al McTavish Photography.
6.4 Prohibited uses
Images may not be:
Sold, licensed or submitted to stock photography websites
Used to promote a business, product or service without written permission
Altered or manipulated in a way that materially changes the original work
Used in a way that falsely suggests an endorsement or commercial relationship with Al McTavish Photography
Used in connection with material that is unlawful, discriminatory, hateful or otherwise harmful
6.5 Social media credit
Credit to Al McTavish Photography when sharing images online is always appreciated but is not required unless otherwise agreed in writing.
7. Image Alterations
The photographs delivered to you are an expression of my artistic style and creative work.
Please do not apply filters, significantly alter, recolour, retouch or otherwise manipulate the final images.
If you would like a particular adjustment made to an image, please contact me. Where possible, I am happy to consider reasonable editing requests.
Cropping for personal social media use is permitted where necessary for the platform's format, provided the image is not otherwise altered.
8. Privacy & Sharing Your Images
I love sharing my work and documenting the beautiful families I photograph, but I understand that photographs of your family and children are personal.
Unless you tell me otherwise, you give Al McTavish Photography permission to use photographs from your session for portfolio, website, social media, advertising and other business promotion purposes.
If you would prefer that your images are not shared publicly, please let me know at the time of booking. I will respect your request and will not use your photographs for promotional purposes.
You may also contact me at any time to discuss your privacy preferences.
9. Family & Child Safety
The safety and comfort of your family, particularly children and newborns, is always the priority during a session.
Parents or legal guardians remain responsible for the supervision and safety of their children throughout the session.
I may pause, modify or stop a session if I believe continuing would create a safety concern or if a child or family member becomes distressed.
For newborn sessions, I will never place a baby in a position that I believe is unsafe.
10. Weather & Location
Outdoor sessions may need to be rescheduled due to rain, extreme temperatures, unsafe conditions or other circumstances that may significantly affect the session.
I will make the final decision regarding whether conditions are suitable for photography, with the safety and comfort of your family as the priority.
Where possible, I will work with you to find an alternative date or suitable location.
11. Referral Program
11.1 Referral credit
Referral credit is applied once the referred client has completed and paid for their eligible session.
For each successful referral, the referring client may choose:
$50 session credit, or
$50 print store credit
The referred client receives $25 off their first full-priced session.
11.2 Referral conditions
Referral credits:
Are non-transferable
Cannot be exchanged for cash
Are limited to one referral credit per booking
May not be combined with other offers unless otherwise stated
Are valid for full-priced sessions only
Do not apply to mini sessions, seasonal promotions or other discounted sessions unless specifically stated
Expire 12 months from the date they are issued
There is no limit to the number of successful referrals a client may make.
Al McTavish Photography reserves the right to amend or discontinue the referral program. Any changes will not affect referral credits that have already been earned and issued.
12. Australian Consumer Law
Nothing in these Terms & Conditions is intended to exclude, restrict or modify any rights or remedies you may have under the Australian Consumer Law or other applicable laws.
Where Australian Consumer Law provides a right, guarantee or remedy that cannot legally be excluded, that right, guarantee or remedy continues to apply.
These Terms & Conditions should be read subject to those rights.
